Proposed Amendments to Subordinate Local Laws

PUBLIC NOTICE

Local Government Act 2009 

1. Burdekin Shire Council (“Council”) has proposed to make each of—

(a) Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2014; and
(b) Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2014; and
(c) Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2014; and
(d) Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2014.

2. Possible anti-competitive provisions have been identified in each of—

(a) Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2014; and
(b) Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2014; and
(c) Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2014.

3. Council has proposed to conduct a public interest test in relation to possible anti-competitive provisions identified in the proposed subordinate local laws referred to in paragraph 2.

4. Various local laws authorise the making of the proposed subordinate local laws as follows—

(a) Local Law No. 1 (Administration) 2012 authorises the making of Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2014, Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2014, Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2014; and
(b) Local Law No. 4 (Local government Controlled Areas, Facilities and Roads) 2012 authorises the making of Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2014.

5. The proposed subordinate local laws amend current subordinate local laws as follows—

(a) Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2014 amends Subordinate Local Law No. 1.6 (Operation of Camping Grounds) 2012; and
(b) Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2014 amends Subordinate Local Law No. 1.8 (Operating of Caravan Parks) 2012; and
(c) Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2014 amends Subordinate Local Law No. 1.11 (Operation of Rental Accommodation) 2012; and
(d) Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2014 amends Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2012.

6. The purpose and general effect of the proposed subordinate local laws is as follows:-

(a) Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2014  regulates sanitary and other associated facilities at camping grounds; and
(b) Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2014 regulates sanitary and other associated facilities at caravan parks; and
(c) Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2014 regulates laundry and kitchen facilities at rental accommodation; and
(d) Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2014 regulates the undertaking of restricted activities at the Home Hill Comfort Stop.

7. Written submissions by any person in support of, or objecting to, the proposed subordinate local laws are invited for a 21 day period commencing on Thursday 20 November 2014 and ending on Wednesday 10 December 2014 (the “consultation period”).

8. During the consultation period Council will make available for inspection and purchase copies of —
(a) the proposed subordinate local laws; and
(b) a public interest test plan about the possible anti competitive provisions included in the proposed subordinate local laws.

Copies will be made available at the Council Chambers, 145 Young Street, Ayr;  the Burdekin Library, Graham Street, Ayr;  and the Home Hill Library, Ninth Avenue, Home Hill during normal office  hours or can be found on Council’s website www.burdekin.qld.gov.au

9. Submissions must be received on or before Wednesday 10 December 2014 stating—

(a) the grounds of the submission; and
(b) the facts and circumstances relied on in support of the grounds.
