Making of subordinate local laws

1.  Burdekin Shire Council (the “Council”) has, by resolution dated the  24th day of March 2015, made each of –

(a)  Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2015; and

(b)  Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2015; and

(c)  Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2015; and

(d)  Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2015.

Subordinate local laws amended

2.  Each subordinate local law identified to in paragraph 1 amends an existing subordinate local law as follows –

(a)  Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2015 amends Subordinate Local Law No. 1.6 (Operation of Camping Grounds) 2012;

(b)  Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2015 amendsSubordinate Local Law No. 1.8 (Operation of Caravan Parks) 2012

(c)  Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2015 amends Subordinate Local Law No. 1.11 (Operation of Rental Accommodation) 2012; and

(d)  Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2015 amends Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2012.

Authorising local law

3.  Various local laws authorise the making of the subordinate local laws identified in paragraph 1 as follows—

(a)  Local Law No. 1 (Administration) 2012 authorises the making of Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2015, Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2015 and Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2015; and

(b)  Local Law No. 4 (Local government Controlled Areas, Facilities and Roads) 2012 authorises the making of Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2015.

Purpose and general effect

4.  The purpose and general effect of each subordinate local law identified in paragraph 1 is as follows-

(a)  Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2015  regulates sanitary and other associated facilities at camping grounds; and

(b)  Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2015 regulates sanitary and other associated facilities at caravan parks; and

(c)  Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2015 regulates laundry and kitchen facilities at rental accommodation; and

(d)  Local Government Controlled Areas, Facilities and Roads (Amendment) Subordinate Local Law (No. 1) 2015 regulates the undertaking of restricted activities at the Home Hill Comfort Stop.

Anti-competitive provision

5.  An anti‑competitive provision is contained in each of-

(a)  Operation of Camping Grounds (Amendment) Subordinate Local Law (No. 1) 2015; and

(b)  Operation of Caravan Parks (Amendment) Subordinate Local Law (No. 1) 2015; and

(c)  Operation of Rental Accommodation (Amendment) Subordinate Local Law (No. 1) 2015.

Consolidated version of subordinate local laws

6.  Council has, by resolution dated the 24th day of  March 2015, adopted a consolidated version of each of –

(a)  Subordinate Local Law No. 1.6 (Operation of Camping Grounds) 2012; and

(b)  Subordinate Local Law No. 1.8 (Operation of Caravan Parks) 2012; and

(c)  Subordinate Local Law No. 1.11 (Operation of Rental Accommodation) 2012; and

(d)  Subordinate Local Law No4 (Local Government Controlled Areas, Facilities and Roads) 2012.

Inspection

7.  Copies of each subordinate local law identified in paragraph 1 and each consolidated version of a subordinate local law identified in paragraph 6 may be—

(a)  inspected and purchased at Council’s public office at 145 Young Street, Ayr; and

(b)  viewed by the public on the website of the Department of Local Government.
