What is an overgrown allotment?

An overgrown allotment can include both vacant land or land with buildings or homes which in the opinion of an authorised officer contains grass, weeds, plants or other vegetable growing in such quantity and in such a condition as to be likely to form a breeding place or harbourage for vermin.

What action does Council take?

An inspection is carried out to determine the extent of the breach. If an authorised officer believes the allotment is overgrown then a Compliance Notice is issued on the owner requiring them to clear the land to Council’s satisfaction within a certain period of time, usually 14 days.

What happens in the event of non-compliance?

Should the owner fail to clear the land within the specified period:

(a) The owner is advised in another letter that Council will enter upon the property and carry out the required works at a certain time.

(b) After Council’s contractor enters and undetakes the required work all of the costs  incurred from this action will become a charge upon the land.
