BURDEKIN SHIRE COUNCIL NOTICE OF AMENDMENT OF SUBORDINATE LOCAL LAWS

At its Ordinary Meeting held on 10 February 2026, Council resolved to:
- make Amending Local Law No. 1 (Temporary Homes, Animals, Environment, Controlled Areas and Traffic) 2026;
- adopt Consolidated Subordinate Local Law No. 1.3 (Establishment or Occupation of a Temporary Home) 2012, incorporating amendments to 10 February 2026;
- adopt Consolidated Subordinate Local Law No. 2 (Animal Management) 2012, incorporating amendments to 10 February 2026;
- adopt Consolidated Subordinate Local Law No. 3 (Community and Environmental Management) 2012, incorporating amendments to 10 February 2026;
- adopt Consolidated Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2012, incorporating amendments to 10 February 2026; and
- adopt Consolidated Subordinate Local Law No. 5 (Parking) 2012, incorporating amendments to 10 February 2026.
Amending Local Law No. 1 (Temporary Homes, Animals, Environment, Controlled Areas and Traffic) 2026 amended the following local laws:
- Subordinate Local Law No. 1.3 (Establishment or Occupation of a Temporary Home) 2012;
- Subordinate Local Law No. 2 (Animal Management) 2012;
- Subordinate Local Law No. 3 (Community and Environmental Management) 2012;
- Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2012; and
- Subordinate Local Law No. 5 (Parking) 2012.
Subordinate Local Law No. 1.3 (Establishment or Occupation of a Temporary Home) 2012 is authorised by Local Law No. 1 (Administration) 2012 and has been amended to:
- refer to current planning legislation; and
- require applicants wanting to establish or occupy a temporary home to have in place a current development approval or building permit for the construction or renovation of a permanent residence on the land.
Subordinate Local Law No. 2 (Animal Management) 2012 is authorised by Local Law No. 2 (Animal Management) 2012 and has been amended to:
- regulate the keeping of peafowl;
- reduce regulation of dogs and cats on multi-residential premises;
- reduce restrictions on certain animals in central business districts; and
- improve readability of Schedules 1 and 2.
Subordinate Local Law No. 3 (Community and Environmental Management) 2012 is authorised by Local Law No. 3 (Community and Environmental Management) 2012 and has been amended to:
- prohibit the burning of waste in the local government area, except for dry wood material appropriate for barbecues and firepits; and
- declare that the building appearance provisions in Part 6A of Local Law No. 3 (Community and Environmental Management) 2012 apply to the whole of the local government area.
Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2012 is authorised by Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2012 and has been amended to:
- prohibit camping at certain boat ramps and landings; and
- update the list of local government controlled areas.
Subordinate Local Law No. 5 (Parking) 2012 is authorised by Local Law No. 5 (Parking) 2012 and has been amended to:
- declare the Ayr traffic area and Home Hill traffic area, to allow for parking regulation of these areas by the local government under the Transport Operations (Road Use Management) Act 1995 (the TORUM Act); and
- remove the declared off-street parking area Commonwealth Bank Carpark, Macmillan Street, Ayr.
A copy of each local law may be inspected and purchased at Council’s Ayr Office and viewed by the public on the department’s website.
