Notice of making of subordinate local law

At its Ordinary Meeting held on 23 June 2026, Council resolved to make Subordinate Local Law No. 8 (Waste Management) 2026.

Subordinate Local Law No. 8 (Waste Management) 2026 is authorised by Local Law No. 8 (Waste Management) 2018.

The purpose of this subordinate local law is to supplement Local Law No. 8 (Waste Management) 2018 in order to protect the public health, safety and amenity related to waste management, by providing for—

  1. requirements for the storage, servicing and removal of waste; and
  2. conditions regulating the disposal of waste at waste facilities; and
  3. matters to ensure that an act or omission does not result in—
    1. harm to human health or safety or personal injury; or
    2. property damage or loss of amenity; or
    3. environmental harm or environmental nuisance.

Subordinate Local Law No. 8 (Waste Management) 2026 prescribes the following:

  1. A bulk bin is prescribed to store general waste at multi-residential premises or commercial premises where an alternative service is in place. The bulk bin must have a capacity not less than the equivalent total volume of the standard general waste containers that would otherwise be supplied to the premises based on the serviced customers.
  2. In addition to the types of waste that Local Law No. 8 states are not permitted to be placed in a waste container, the following items are not permitted to be placed in a bulk bin or standard general waste container:
    1. hot ashes or acid;
    2. lead acid batteries, imbedded batteries, household batteries or vapes;
    3. wire;
    4. tyres or engine parts;
    5. chemicals and pesticides;
    6. industrial waste;
    7. medical and clinical waste including untreated sharps;
    8. gas bottles and fire extinguishers;
    9. paints and solvents;
    10. motor and cooking oils;
    11. heavy material such as concrete, bricks, timber, soil and rocks;
    12. asbestos, explosives and other hazardous material; and
    13. flares and EPIRBS.
  3. Only domestic waste or commercial waste is permitted to be placed in the red-lidded bin.
  4. Only recyclable waste is permitted to be placed in the yellow-lidded bin.
  5. Only green waste is permitted to be placed in the lime-green-lidded bin.
  6. The occupier of a premises must ensure that bins are stored within the property boundary.
  7. The occupier of a premises must ensure that a bin brought out for emptying is taken back in by 6pm on the day after the scheduled collection day.
  8. The occupier of premises where there is industrial waste must do the following:
    1. supply at the premises adequate industrial waste containers for storing the waste at the premises safely, efficiently and without causing a nuisance;
    2. keep the waste containers within the property boundary at the premises; and
    3. keep each such waste container clean and in good repair.
  9. The occupier of premises where there is industrial waste must separate out regulated waste and asbestos waste and transport it to a waste facility.
  10. In addition to the types of waste that Local Law No. 8 states are not permitted to be disposed of at a waste facility, a person must not deposit the following waste at a waste facility:
    1. liquescent waste streams or any waste capable of yielding free liquids;
    2. untreated infectious and chemical wastes and liquid pharmaceuticals from clinical and related waste stream;
    3. cytotoxic wastes;
    4. untreated sharps;
    5. S8 pharmaceuticals;
    6. all radioactive wastes, unless approved under the Radioactive Substances Act 1958;
    7. pyrophoric wastes (where co-disposed with other potentially combustible material); and
    8. explosives and ammunition, pyrotechnics or propellants, apart from trace residues no longer capable of supporting combustion or an explosive reaction.
